Welcome to Coinyex Co., Ltd., a digital asset exchange licensed in Labuan Malaysia under the Labuan Financial Services Authority. By accessing or using our services, you agree to be bound by the following terms and conditions, which constitute a legally binding agreement between you and Coinyex Co., Ltd. Please read these terms and conditions carefully before using our services.

 

1. Services Provided
   • Coinyex Co., Ltd. provides the following services:
     • Crypto to fiat currency exchange (custodian service)
     • crypto to crypto exchange (Noncustodial)
     • Support the issuance of various bank and debit cards which can be used globally

2. Sanctioned Countries
   • Coinyex Co., Ltd. will not provide services to individuals or entities in the following sanctioned countries:
     • Afghanistan
     • Central African Republic
     • Cuba
     • Iran
     • Iraq
     • Libya
     • North Korea
     • Somalia
     • Sudan
     • Syria
     • Ukraine (Crimea/Sevastopol)
     • Yemen
     • Zimbabwe

3. AML/KYC Compliance
   • Coinyex Co., Ltd. is committed to complying with Anti-Money Laundering (AML) and Know Your Customer (KYC) global standards to protect our users and the reputation of our service. Users will be required to provide accurate and up-to-date information, including but not limited to their full name, date of birth, residential address, nationality, occupation, and source of funds.
   • Coinyex Co., Ltd. may conduct background checks on users, including screening their names against government watchlists and sanctions lists.
   • Coinyex Co., Ltd. may require users to provide additional information or documentation at any time to verify their identity and ensure compliance with AML/KYC requirements.
   • Coinyex Co., Ltd. reserves the right to terminate the account of any user who fails to comply with our AML/KYC policies.

 

4. Risks of Using Our Services
   • The use of our services involves risks, including but not limited to the following:
     • Price volatility of digital assets
     • Hacking and cyber attacks
     • Regulatory and legal risks
     • Liquidity risks
     • Operational risks
   • Coinyex Co., Ltd. is not responsible for any losses incurred by users as a result of using our services.

 

5. User Responsibilities
   • Users are responsible for maintaining the security of their account credentials, including but not limited to their password and 2-factor authentication code.
   • Users are responsible for ensuring the accuracy and completeness of the information they provide to Coinyex Co., Ltd.
   • Users are responsible for complying with all applicable laws and regulations when using our services.

 

6. Prohibited Activities
   • Users are prohibited from using our services for any of the following activities:
     • Illegal activities, including but not limited to money laundering and terrorism financing
     • Fraudulent activities, including but not limited to phishing and scamming
     • Activities that violate the intellectual property rights of Coinyex Co., Ltd. or any third party
     • Activities that disrupt the operation or integrity of our services, including but not limited to hacking, denial of service attacks, and spamming
     • Activities that violate any applicable laws or regulations
     • Any other activity that Coinyex Co., Ltd. deems to be inappropriate or harmful to our services, users, or reputation.

 

7. Fees and Taxes
   • Users are responsible for paying any fees associated with their use of our services, including but not limited to trading fees and withdrawal fees.
   • Users are responsible for paying any taxes or duties that may be applicable to their use of our services.
   • Coinyex Co., Ltd. reserves the right to modify the fees associated with our services at any time.
8. Intellectual Property
   • All content and materials on the Coinyex Co., Ltd. website, including but not limited to text, graphics, logos, and software, are the property of Coinyex Co., Ltd. or its licensors and are protected by intellectual property laws.
   • Users are not permitted to use or reproduce any of the content or materials on the Coinyex Co., Ltd. website without the express written consent of Coinyex Co., Ltd.
9. Limitation of Liability
   • Coinyex Co., Ltd. shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services, including but not limited to damages for loss of profits, loss of data, or loss of goodwill.
   • Coinyex Co., Ltd.'s liability to users shall be limited to the amount of fees paid by the user to Coinyex Co., Ltd. for the use of our services.

22. Anti-Money Laundering (AML) and Know Your Customer (KYC) Policies
    • Coinyex Co., Ltd. adheres to strict AML and KYC global standards to protect our users and the reputation of our services.
    • Users may be required to provide personal identification documents and other information as part of our AML and KYC policies.
    • Coinyex Co., Ltd. reserves the right to suspend or terminate a user's account if we suspect any fraudulent or illegal activity or if the user fails to comply with our AML and KYC policies.
23. Bank and Debit Cards
    • Coinyex Co., Ltd. supports the issuance of various bank and debit cards that can be used globally.
    • The availability and terms of these cards are subject to change at any time without prior notice to users. Users are responsible for reviewing the most current terms and conditions of these cards.
24. Governing Law and Dispute Resolution
    • These terms and conditions shall be governed by and construed in accordance with the laws of Malaysia.
    • Any dispute arising out of or in connection with these terms and conditions, including any question regarding their existence, validity, or termination, shall be resolved by arbitration in accordance with the rules of the Asian International Arbitration Centre ("AIAC").
    • The seat of the arbitration shall be in Kuala Lumpur, Malaysia, and the language of the arbitration shall be English.
    • The award rendered by the arbitrator shall be final and binding on he parties, and judgment thereon may be entered in any court of competent jurisdiction.
    • The parties agree to maintain the confidentiality of the arbitration proceedings and any information disclosed during the arbitration.

 

25. Amendments
    • Coinyex Co., Ltd. reserves the right to amend these terms and conditions at any time, in our sole discretion.
    • Any amendments to these terms and conditions will be effective immediately upon posting on our website.
    • Users are responsible for reviewing the most current version of these terms and conditions before using our services.
    • If users do not agree to the amended terms and conditions, their sole recourse is to discontinue using our services.
26. Assignment

42. "Noncustodial" means the exchange service that does not involve the custody of users' digital assets.
43. "Sanctioned countries" means countries subject to economic or trade sanctions imposed by the United States government or other international organizations.
44. "Services" means the services provided by Coinyex Co., Ltd., including but not limited to the crypto to fiat exchange (custodian service), noncustodial crypto to crypto exchange service, and support for the issuance of various bank and debit cards.

 

39. Governing Law and Jurisdiction
    • These terms and conditions shall be governed by and construed in accordance with the laws of Malaysia, without giving effect to any choice or conflict of law provision or rule.
    • Users irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Malaysia in any legal action or proceeding arising out of or relating to these terms and conditions or the services provided by Coinyex Co., Ltd.
40. Language
    • The language of these terms and conditions and all communications and documentation relating to these terms and conditions shall be English.

 

41. Acknowledgment and Acceptance
    • By using the services provided by Coinyex Co., Ltd., users acknowledge that they have read, understood, and agree to be bound by these terms and conditions.
    • If users do not agree to these terms and conditions, they must not use the services provided by Coinyex Co., Ltd.

 

42. Changes to Terms and Conditions
    • Coinyex Co., Ltd. reserves the right to modify or update these terms and conditions at any time, without notice, by posting the revised version on its website.
